That's an issue with the current EQEmu revision we are using, aka nothing we can fix easy if at all.

We are looking into upgrading to the latest rev which hopefully has a fix for this.

As this is a very tedious task tho, don't hold your breath. Sorry, no ETA at this time.

The issue you're having is that it is working on client side but then not matching up server side. There has to be server side code to accommodate client side (or else easy exploiting). Will check to see if it has recently been added. If not, will get to it in the next few days.

Going through old posts for the class changes forums. This is still an unsolved problem. Bumped for Striat's attention.

Here's my tip for that. I've noticed if you wait about 1 second after it pops, you do not receive that message and your backstab will not be used even though you don't get the damage from it. Simply put, when the skill pops, just say one one thousand in your head and it should work just fine. This is still a LARGE decrease on the use timer of backstab. Hope that helps! (at least till this is fixed)
